Leaderboard Photography – Sporting Photography (UK)

Agreement

By booking or engaging the services of Leaderboard Photography, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. These Terms and Conditions apply to all bookings unless otherwise agreed in writing.

1. Definitions

  • “Photographer” means Leaderboard Photography.

  • “Client” means any individual, company, organisation, club, or event organiser engaging the Photographer.

  • “Images” / “Photographs” means all photographs taken by the Photographer during any assignment.

2. Bookings and Payment

  • All bookings are subject to availability and written confirmation by the Photographer.

  • Payment terms, including deposits and final balances, will be agreed at the time of booking.

  • Leaderboard Photography reserves the right to withhold delivery of images until full payment has been received.

3. Copyright

  • All photographs are protected under the Copyright, Designs and Patents Act 1988.

  • Copyright remains the sole property of Leaderboard Photography unless explicitly transferred in writing.

  • No copyright is transferred through payment unless agreed in advance.

4. Licence for Individual Clients (Personal Use)

  • Individual clients are granted a non-exclusive, non-transferable licence to use images for personal use only.

  • Personal use includes:

    • Personal social media accounts

    • Personal websites

    • Printing for personal display

  • Images must not be:

    • Sold

    • Used for commercial or promotional purposes

    • Supplied to clubs, teams, sponsors, brands, or organisations

without an additional licence.

5. Licence for Companies, Clubs, and Event Clients (Business Use)

  • Business, club, and event clients are granted a licence to use images for their own internal and external business purposes, as agreed at the time of booking.

  • Permitted uses may include:

    • Company or club websites

    • Social media

    • Marketing and promotional materials

  • Images may not be redistributed to third parties (including athletes, competitors, sponsors, media outlets, or other organisations) without written consent or an additional licence.

6. Redistribution and Extended Licensing

  • Redistribution or sharing of images with:

    • Sports competitors

    • Teams or clubs

    • Associations or governing bodies

    • Media outlets

    • Other sports groups

is not permitted by default.

  • An extended usage licence or copyright licence may be purchased at an additional cost, subject to written agreement.

7. Editing and Alteration

  • Images must not be altered, edited, filtered, or manipulated without the Photographer’s written consent.

  • Cropping for layout purposes is permitted, provided it does not remove watermarks or materially alter the image.

8. Credit

  • Where reasonably practicable, images should be credited as:

  • Credit does not remove the requirement for correct licensing.

9. Photographer’s Right to Use Images

  • Leaderboard Photography retains the right to use images for:

    • Portfolio

    • Website

    • Social media

    • Marketing and promotional materials

  • Requests for image confidentiality must be agreed in writing prior to the assignment.

10. Cancellations and Force Majeure

  • Cancellation and rescheduling terms will be confirmed at the time of booking.

  • Leaderboard Photography shall not be liable for failure to perform services due to events beyond reasonable control, including but not limited to weather conditions, venue restrictions, or participant availability.

11. Limitation of Liability

  • Leaderboard Photography will exercise reasonable care and skill in the delivery of services.

  • Liability is limited to the total amount paid by the Client.

  • Leaderboard Photography shall not be liable for indirect or consequential loss.

12. Governing Law

  • These Terms and Conditions are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.
